I just finished putting a new track on my viper, my old one had 38mm height lugs but the new one has 40mm so I'm concerned about clearance, so I'll just let the pics talk
I have lifted the rear of the sled from the ground and let the track spin a few times and I do not hear any rubbing,
also how do I know when the track is tight enough ?

Never got into the metric system LOL! So if my math is right a 40MM lug would be about a 1.5 inch lug. You will be fine. It does look snug but ive never seen one in a viper just know guys run them all the time with the protectors removed which you did. Spec track tension is 25-30mm (about 1inch) sag with 10kg (22lbs) of force pushing down. Measure at bottom of rail by the rubber bumper. OEM spec is a bit tight but you will want it tight by the looks of it.

I dont see any issue for concern either. You should be good to go.
